In a statement on Friday, a Harvard spokesman, Jason Newton, said the university was \u201ccommitted to following the law, including civil rights laws in connection with admissions and financial aid.\u201d\u201cHarvard has been responding to the government\u2019s inquiries in good faith and continues to be willing to engage with the government according to the process required by law,\u201d Mr. Newton added. \u201cThe university will continue to defend itself against these retaliatory actions which have been initiated simply because Harvard refused to surrender its independence or relinquish its constitutional rights in response to unlawful government overreach.\u201dLast fall, the percentage of Black students in Harvard\u2019s first-year class dropped to 11.5 percent from 14 percent in 2024 and 18 percent in 2023, before the Supreme Court decision took effect, while the percentage of Hispanic students saw a similar decline. But a report this month from Class Action, a nonprofit that promotes equity in education, concluded Black and Hispanic admissions have increased at public flagship universities since the ruling.Friday\u2019s lawsuit, filed in Federal District Court in Boston, was assigned to Judge Myong J. Joun, who was appointed by former President Joseph R. Biden Jr. And it represented an extension of the Trump administration\u2019s monthslong campaign against Harvard.The administration initiated a \u201ccompliance review\u201d of Harvard\u2019s admissions process in April, and the next month, the Justice Department opened an investigation into Harvard\u2019s admissions under the False Claims Act, a law designed to punish those who swindle the government.That investigation, like several other inquiries into the university, did not detail a specific allegation of wrongdoing. Instead, the primary focus was a demand for a trove of documents and written answers to a list of questions.The government has also sought text messages, emails and other communications from Harvard officials discussing Mr. Trump\u2019s executive orders last year aimed at rooting out diversity, equity and inclusion programs.Harvard has produced more than 2,300 pages of admissions-related documents to the government, according to the Justice Department\u2019s lawsuit. But the administration argues that the university has not released the \u201capplicant-level\u201d data it is seeking.The government is seeking a searchable, electronic spreadsheet with individual-level data that identifies applicants\u2019 race and ethnicity, economic indicators, undergraduate class rank and grade point average, scores on the Medical College Admission Test and any internal rankings.The Justice Department has also demanded Harvard provide any factors and ratings included in what is known as a \u201cholistic review\u201d of applicants, which is a process aimed at supplementing academic metrics with a broader evaluation of factors such as character or personal growth. Colleges typically include essays and letters of recommendation as part of that process.The department needs this applicant-level admissions data to determine whether Harvard is complying with civil rights laws and the Supreme Court decision, according to the lawsuit.\u201cIf Harvard has stopped discriminating, it should happily share the data necessary to prove it,\u201d Harmeet K. Dhillon, the assistant attorney general for civil rights, said in a statement.Harvard was one of the schools at the center of the Supreme Court\u2019s affirmative action ruling in 2023, and since Mr. Trump took office last year, his administration has repeatedly insinuated that the university has flouted the court\u2019s decision. In a letter last May, for instance, Education Secretary Linda McMahon accused the university of continuing \u201cto engage in ugly racism in its undergraduate and graduate schools.\u201d\u201cOur universities should be bastions of merit that reward and celebrate excellence and achievement,\u201d Ms. McMahon said in the letter, which Mr. Trump and Stephen Miller, a top White House official, played a direct role in writing. \u201cThey should not be incubators of discrimination that encourage resentment and instill grievance and racism into our wonderful young Americans.\u201dLater in the year, as Harvard and the administration considered a settlement to their wide-ranging clash, ongoing government access to admissions data was a sticking point.
