By Marc Elias · Democracy Docket founder

"If you want to enjoin us, enjoin us." Those were the words of Joshua Schopf, a trial attorney in the Justice Department's Civil Division, after a federal judge said she would require the government to provide advance notice before releasing state citizenship lists or activating a portal that gives state election officials access to the lists.

Schopf was defending the administration against a lawsuit brought by the Electronic Privacy Information Center challenging the creation and release of those lists. The lists, which are the subject of multiple lawsuits, are almost certain to be riddled with errors. They are a core part of Trump's plan to weaponize data to threaten election officials and disenfranchise voters.

Lawyers do not typically invite federal judges to rule against their clients. And DOJ lawyers are usually among the most straightforward in how they respond to court orders.

So, at first blush, the DOJ lawyer's invitation to grant the relief sought by the privacy group seemed out of place. The judge seemed somewhat taken aback.

But in this instance, the lawyer representing Todd Blanche's DOJ was being intentionally provocative. He appeared to be trying to bait the judge into issuing an injunction, which the DOJ could immediately appeal.

The judge refused to take the bait. "I'm not doing anything to enjoin you," she replied.

This exchange, prompted by a routine request from a federal judge to be kept abreast of developments that could affect the case before her, is a microcosm of what it is like to litigate voting and election cases against the current DOJ.

Civility and respect for judges have been replaced by bravado and not-so-subtle challenges to the courts' authority. Lurking in every case is the question of whether the Trump administration will obey the rulings that go against it.

Even more corrosive is the constant secrecy and misinformation. Government lawyers seem to have been instructed by their bosses never to tell the whole story. Factual representations by government lawyers are no longer trusted because they cannot be relied upon to tell the whole truth.

This lack of transparency makes fast-paced, time-sensitive litigation more burdensome than it needs to be. Recall that early in the administration, DOJ lawyers were caught giving a federal judge incomplete information about the government's plans to fly Venezuelan migrants to a notorious prison in El Salvador.

That pattern has repeated itself in nearly every area of emergency litigation involving the DOJ ever since. With the midterm elections only weeks away, it now pervades virtually every election-related case.

Earlier this month, the Democratic Party filed a motion in a separate lawsuit challenging the citizenship lists. The motion argues that the DOJ had failed to keep the judge in that case apprised of developments despite being instructed to do so. My law firm and I represent the plaintiffs in that case.

And then there is the steady stream of leaks and whistleblower complaints revealing how urgently the White House and senior government officials want to make voting more difficult before the midterms. Yet absent from all those accounts are any reports of DOJ or other government lawyers raising concerns.

Notwithstanding Schopf's objections, the judge issued an order on Friday requiring the government to give 30 days' notice before it activates the portal or provides state citizenship lists. She also ordered the administration to notify her immediately if it plans to release the lists or the portal before the midterms.

So the question now is: What will the DOJ do?

If the DOJ complies, the earliest the lists could be released is Oct. 28, just six days before Election Day. And with the election only five weeks away, no notice has been filed.

Donald Trump clearly expects this new voter suppression tool to be in place for the midterms. Every day that passes makes that harder.

Trump and his party likely do not care what a federal judge in Maryland, appointed by a Democratic president, thinks. They are unlikely to give up the advantage of releasing these lists at the moment that suits them best simply to comply with her notice requirement.

If the administration releases the lists without notice, the consequences for the DOJ may come later, if they come at all. One of the great failures of this era has been the unwillingness of judges to hold government lawyers to account. When they do, higher courts, including the Supreme Court, have failed to back them up.

That is why we find ourselves facing an election in little more than a month with an open question as to whether the federal government will comply with a judge’s order.

For decades, courts have extended the government a presumption of regularity, trusting that its lawyers are telling the truth and that its officials will follow the law. This DOJ has forfeited that trust.

"If you want to enjoin us, enjoin us." Schopf meant it as a taunt. Courts should take it as an invitation.

We’re grateful for your support at the highest level.
